But they just use a different name on the product. For example, Nyquil and Equate Night Time.....obviously the first is made by Nyquil and the second Walmart. What's up with that?

Actually a very clever trick. People always prefer a specific brandname. Therefor, if the company own both brandnames, they get all the customers. And it's not against the law.

Once a patent expires, the product is free game and anyone can market it as long as they use their own company and name
