My apartment complex has had people getting followed home after work and robbed at gun point. Ive seen some suspicious vehicles semi tailing her after work coming home a couple days that fits the Robbers vehicle description.
I keep a rifle and wait for her everyday so she doesnt get robbed when she parks..
What happens if they decide to hold her up and I pop a cap in the guy robbing her?

Isnt that necessary force?

I used Necessary force to win another case of felony assault against me for beating on 7 punk rockers at once, then putting 3 of them in the hospital. They started harrassing my wife, and threatening us.
It worked just fine Wouldnt it be necessary for me to cap this guy because he has a gun on my wife? I dont intend on killing him unless I have to.
A shot to the knee is my preference.
Surely im allowed to provide cover fire for my wife.
I wait for her everyday to ensure they dont follow her.
I dont see walking around the apartment parkinglot with a rifle wise

yes police have been notified, and yes they ARE holding people up at gun point for purses and jewelry. We are in a nice complex, its hte bad ones down the road they are coming from.
Im moving in 15 days... already planning on getting out of here..

Necessary force is the force needed to stop violence against yourself or another person. Whether it is justified or not, that is something for a judge or a jury to decide. While I am not a lawyer, I can't imagine that a civilian sniper would be considered "necessary" force even if the robber had a gun. It would fall into the extenuating of extenuating circumstances.

What I don't see in your actions are you calling the police to report a vehicle that matches the description of the robber vehicle. Instead, you are preparing for a situation that could be avoided. Call the cops, report the car, and make the neighborhood safer for everyone, not just you and your wife.

P.S. Your previous "necessary" force case doesn't apply for this situation.

To me this would be seen as premeditation. Defending your wife is one thing but planning out said defence is another. Have you notified police? How bout videoing the vehicles and meeting your wife in the parking lot as she arrives? What you are talking about to me just sounds like vigalanteism.

#1- MOVE OUT OF THERE

#2- 'Providing cover fire' would be viewed as premeditated.. the defense attorney would be all over you like stink on toilet paper.

#3- Get your wife a cellphone so she can call as she is coming up to the curb. Walk down that and personally escort her back up until you can get out of there.
