my girlfriend is getting her Notary licence ,(state of California)
Her company paid for everything including all her equipment for her to do this. there is a $10.00 fee for notary service. If she does notary work for the company at work . Should she get the notary fee or does the company get that money ?

If it is a part of her job requirements, then the company gets that money.

If she were 'contracted' for notary services, then the fees would be hers.

It depends on the agreement that her employer and her agree to. Before they paid for all her training and equipment she should have asked for something in writing. If she doesn't have anything, she should ask about it now.

I'm a California Notary too and my company paid for the class and supplies. I notarized business related documents at my old job at work during my business hours and I did not charge a fee. If someone had non-business related documents, personal or not related to my employer, I was allowed to notarize those documents on my own time and charge a fee and keep the money.

When I left that job, I was asked if I wanted to keep the equipment and my Notary commission and I said "yes" and they wrote a letter that HR and I signed stating that the company was releasing their interest in my services or something akin to that. Basically that meant that if I made a million dollars notarizing things after I left, they were OK with that.

If your girlfriend or her employer doesn't know, she should contact the State, a Notary association and possibly a lawyer. A $10 fee may not seem like much but there can be legal implications.

While I believe she should be compensated for her work as a notary, it is her company who sponsored her and therefore may have the right to collect all fees for her service as long as she is a paid employee.

As far as a $10.00 fee for notary service, that is pretty high. It usually goes for $2.00 or $3.00 per signed document.

Some companies are different with their policies but most would keep the fee especially if she is getting paid hourly for her work. If she does it on company time it is pretty much their property. If you work at a car wash, do the customers pay you directly or do they pay the company and the company turn around and pay you?

Anything at the company belongs to the company, anything done privately is hers. The company does not own the license, she does.
