The man got the password of the woman's email through the security question. Is this idenity theft?

It's a federal offense to break in to a password protected system of any kind. Using her password without permission would fall under this statute. As a federal crime, it carries jail time.

I think it depends on what he does with this knowledge. The best answer is that the woman should change her password on a regular basis as most security experts recomend..
