I moved into a house on friday. We still aren't even unpacked and have a huge problem....the house has fleas everywhere!! They are biting my kids and making us all misrable. Well the landlords had the house sprayed before we moved in, but apparently the eggs hatched and now there is a new flea problem. they are paying to have the house sprayed again to get rid of the problem. The only thing is, we have been advised by the pest control, since we have small children ( 2 year old twins) We should leave the house for 24 hours to make sure the chemicals on the carpets are all dry so that way the kids wont get them on them. The landlords won't pay for the hotel. Do you think they should? Would you push the issue or dish out the hotel fees? Anyone know what our rights are? Thanks!!!!

Ok that's what i was thinking, i would rather the problem be taken care of and eat a little money then have my kids bitten! My mom and brother keep telling me to get the money from the landlords so i wanted some opinions. Thanks!

Most states have rental laws regarding vermin and other pets. YOu need to look it up as it varies state by state. Usually, you can charge the landlord for remediation costs but NOT lost of use costs such as hotel, etc... It's more important to get rid of the fleas then it is to have him pay for the hotel. I would pay for it, and not pursue reimbursement until after the problem is fixed.

Knowing me I would push the issue since the landlord promised to take care of the problem before you moved it. I would call a local attorney to see if you have the right to make him pay.. Hope it works out I also have twins, keeps you busy. But I would stay in a hotel and worry about the cost later. It is best for the kids.

Push it honey!!!!! It is the landlords responsibility to make sure the house was definantly OK to move into in the first place. If there was something wrong with the house that you did not know about untill after moving in than it is his responsibility to fix it and make accomidations to the family renting the property.
FOR EXAMPLE: My husband and I had just rented an apartment and the stove did not work. The landlord came over as soon as we called. he noticed a part missing but he could not purchase the part untill the next morning. WE DID NOT EVEN ASK and he gave my husband and I $20 so that we could have a hot dinner that night. So you see in your situation I would hope that the landlord is not stupid enough to think you do not deserve the money. call your local police department and ask about the situation and see if they can help. Also try to search online for laws about renting property and print them to show it to him. I'm sure he will change his mind quickly

You have all the rights... call your state housing authority & a lawyer... tell the lawyer your problem. it sounds like they would jump all over this with no money out of your pocket... just a piece of the action. Go back to your landlord & tell him you are getting the advice of a lawyer & see if this gets him to do something. You signed a lease for livable quarters & you have to leave already? It's his responsibilty and his answer is to spray poisons throughout your home... poisons linked to Lymphoma.

It is 1 day. What is it $60? I would leave it. It is not worth the stress. The landlord has made a good faith effort to fix the problem. He had a pest control company come in before you moved in. He is having them in again.

if the landlord won't pay for the lodging willingly, I guess you'll just have to eat the cost. It would be more expensive to fight something like this in court. Just dish out the fee is my advice!
