I recently got fired from a "big box" retail store. I saw a guy in the restroom drinking beer that he took off the shelf. I did NOT see the guy take the beer off the shelf, therefore, i am not sure if it was even his beer or the stores beer. At this point. So i followed the guy out of the store and stopped him and said "Hey i have a question for you! Stop!" at which point he turned around and said "Yeah I stole the beer, i stole it and drank it all here. i have more." And he handed me 2 more cans of beer. That's all i said. I didnt ask anything else, he confessed to stealing. So I brought him back into the store, called the cops, and sent him on his way. I was fired because I did not see the man take the beer off the shelf. I "violated" a loss prevention policy. Do I have lawsuit capabilities since my intentions were to protect the company, it's assets, associates, and customers???

I am pretty sure that I know which store you are talking about, as I worked Loss Prevention for them in college for about a year. The policy was that you see them "steal" the merchandise as well as never lose sight of them before they leave the store. At anytime you lost sight of them, they could dump whatever they took. If you stop them outside, and they have nothing, that is how lawsuits come about. Lawsuits cost companies more than the beer the man stole. Therefore, unless you were absolutley sure he stole it, and you had "eyes on him" the whole time before he left the store, they would rather take the loss of a couple beers over having to face yet another lawsuit.
It is in the Loss Prevention Policy, therefore, they could, and seems did, fire you.

It also depends on what state you are working in. Like Kansas is an "At will" state. Meaning the company has a right to fire you and not just you any reasoning to why. I worked at one place an a kid I was training called me a "b*itch". After I told him I do not like being talked to like that, I went to the shift manager and said I would not tolerate being talked to like that. I was terminated the next day.
As for stealing I know in one of the cities here, if you make it to the parking lot there is nothing to store can do to you. You will have to check out all the state and cities laws on both employment and stealing.
Next thing you have to think about. Would it really be worth the time and money to sue the company?

Unfortunately, you MUST see the person taking the beer. What would happen in court when the guy denies telling you he stole it?

You can file a lawsuit but you would be wasting your time. A company has the right to fire you for any reason....however since according to you it was without cause, you should be able to get unemployment.

You can sue anyone for anything you want, that doesn't mean the court will agree with you. But unfortunately, that is true, you have to see it happen with your own eyes before you can stop the person, legally. This is what they trained us at my job, I work Security.
