It seems like there would be a problem with sending the inocent one to jail, or letting the guilty one free.
Keep in mind the inocent one is inocent he tryed to stop the guilty one and is not an accessory to the crime, just a witness.

Obviously the judge should pass a new law from the bench (because we desperately need new laws and more activist judges) declaring that the state is obligated to seperate the twins before trying the accused. To even think of submitting the non accused twin to that would be cruel and unusual.
