It seems like there would be a problem with sending the inocent one to jail, or letting the guilty one free.

Keep in mind the inocent one is inocent he tryed to stop the guilty one and is not an accessory to the crime, just a witness.

What a very clever question.Usually I can think of an answer fast.This has got me puzzled.I would not send the quilty one to jail.A heavy fine and community service.I would give half the fine to the innocent one for his inconvenience

I think you handle this in much the same way you handle any other criminal. Within a criminal there are elements of good which are forced to serve the sentence along with the bad aspects of the criminal. So in this case it is too bad but the twin must also serve the sentence.
