I recently kicked out my room mate... She had promised to either fix her damages or pay for them. At first she said she would sign a "promise to pay" note now refuses. I have substancial evidence that she did infact live with me... Even though she did not sign the lease and I also have pictures of her room before, during, and after she moved in and out. The damages we caused by her dog. And I feel I can prove that. With all this evidence would a judge rule in my favor even without her promis to pay note?

Take it to small claims and you should win.

If you have any mutual friends or the landlord or anything that can attest to the fact that she was indeed living there, and even better, that she had a dog that was perhaps a bit destructive, get them to go to a notary or commission for oaths and sign an affidavit saying so. A notarized letter or affidavit is SOO much better than a quick letter by them and should only cost around 20 bucks. If they can do their letter up first and then just take it in to be sworn that'll save cash.

Even better if any of your friends witnessed some of the damage she or the dog did.

Also, you should get estimates as to the costs of the repairs as well.

You should then be air tight.

Based on my experience watching Judge Judy, I would say no because the roommate was never on the lease and never signed any paperwork which means that when you allowed the dog into the apartment YOU (the only official resident) tacitly agreed to taking on the responsibility.

Yes, if you have evidence that the judge approves of than the judge will rule in your favor. I have no idea how long they give them to pay the amount owed before being put in jail.

yeah that shouldnt be a problem if your pictures are good enough
