If a woman tells her husband that she doesn't want to have sex but he still does it can it be considered rape and if so how can the wife prove that it was?

yes she can it is called spousal rape and is just as much a crime as any other types of rape to prove it she would need to call the police and go through the same process as any other victim not all rape is violent so not having bruises or trauma to her vaginal area do not have to be there for her to prove she was raped the police is her first step and from there they can help her.

yes, a woman can be raped by her husband. If she says 'no' and means no and her husband continues with the act, the most important thing for her to do is not to give in if she really means no. There will be visible signs of forced entry, and a struggle to stop the act. A man really doesn't respect his wife if she says no sex and he takes it. There is a difference when a woman says no because she wants to be persuaded, than when she flat out says no and means it. Her husband will know the difference.

Yes a woman can be raped by her husband! Rape is any sexual intercourse that you didn't want to happen! If she tells her husband no and he does it any way's it's rape if he makes her feel threatened that if she doesn't have sex with him he would hurt her it's rape! She would need to get out of his house as soon as possible and talk to the police and a attorney! No man has a right to force sex on a woman even if he's married to her!

Rape is rape, regardless of the relationship. Yes, it's rape if you don't agree to have sex. If you choose to report it, it's basically your word against his, unless there's physical evidence of bruises, etc. That's why an examination afterwords would be critical to prove rape. And if you are still choosing to be with this person, you might want to get yourself into therapy to consider why and to make some decisions about where to go from here.

A woman can be raped by her husband. If you feel abused or raped by your husband call 911 or go to a hospital. Were you clear that you did not want to have sex? Did he hear and understood the word NO?

well it is a difficult case to prove that a husband raped his wife, however there are things that can lend to your case. Was it violent? Did he force himself very hard upon you, did he tie you up, did he hit you? Maybe he was just trying to get kinky. However to answer the question, Yes it is possible. Yes you should go to the police, but the longer you wait, the less it looks like rape and more like a frame job.

Wow. If no physical harm was provided to you during this episode of your spouse inserting himself into you without your permission.... I think, counseling is the most appropriate thing to go forward with BEFORE law enforcement. The Law Enforcement are not educated enough with this type of behavior and most likely shrug it off.... They would ask if you have any marks on you... then want to photograph you...Then they will question the spouse... If you aren't prepared for that.. then, when they leave your home- you are setting yourself up for much worse abuse (which I hope I am wrong) but, it appears if the spouse "has sex" with or without you... he is most likely going to abuse you in other ways for involving the police. Go get medical help... counseling... get your confidence back and stand as the strong woman you once were. If that means leaving and divorcing... then so it be. Abuse is abuse....

Yes a woman can be raped by her husband. Unfortunately, my guess is that it is even harder to prove than a stranger rape unless there is evidence of associated violence.

Most of society feels that sex is a woman's duty to her husband and therefore probalby feels that the husband is taking what is rightfully his. lets face it...that is what society dictates.

This woman should talk to a rape crisis counsellor asap.

A woman can most definitely be raped by her husband. Unfortunately, some places don't have laws protecting the wife. You need to see a lawyer for a free consultation to see what the laws are in your area. It will be a he said/she said battle.

Yes. There's actual case law on rapes that occur in marriage. If this has happened to you and you want to move forward with it, the file a police report and hire an attorney. You are in for one hell of a ride, but if you were raped, he should be punished!
