depends on what you mean by "background" check ... usually the person in question needs to give permission for someone to get information about them, unless it falls under the Freedom of Information Act (i.e. criminal convictions are a matter of public record that anyone can access). Also, information obtained from background checks are not supposed to be used to discriminate under the Charter of Rights and Freedoms but the information obtained may impact the outcome of why the background check was requested in the first place (i.e. someone who has a criminal record can't be bonded, etc. etc.)

For the purposes of employment for a bondable position back ground checks are perfectly legal, in any other forum you will need to consult you local police, or legal advisory board.

I would imagine that it is not only legal but necessary in many cases. And that also goes for across the globe.
