His names on the birth certificate and he hasn't been paying his child support order since it went through and I haven't heard from him in 5 months. How do I do it, how long do I have to wait? Any ideas on the cost in Missouri?

-sorry I think I made the question confusing. I wanted to know what the laws were regarding child abandonment for a person in my situation. Child support has been taken care of, I just want to make sure he's not able to take her away even though he hasn't seen her for that long.

-she's two now, so this isn't a case of wham-bam, thank you everyone for those concerns though. Several of you had some good advice, I'm going to leave this open for a bit though.

Best advise.. Call a Family Law specialist, they will usually speak to you for free.. also if money is an issue please check out the District Attorney's office in your county, they provide legal assistance to those who can not afford a private attorney. Good luck on dropping that loser from your life... Move on and find yourself someone wonderful, you and your baby deserve it.
Good Luck

No idea on the cost. Try legal aide and they should be able to answer you question. How old is the baby. I don't mean to be insenstive, but I have to ask. Is this about the baby or the fact that he has not contacted you? Take him back to court for the child support. By law if his name is own the bc he has to take care of the baby. I just hate that children get the short end of the baby making business. I don't believe that a "man" has to be made to take care of his child. He has abandon his child without you have to file anything. I wouldn't file because then the child may grow up to believe that you were the reason he did not come and visit.

Lady, Forget the Loser! Why not join the Air force?
See if you can arrange for your parents to have a limited power of attorney of your child, not to last longer than 6 months!
You join the Air Force, within six months you will have completed your basic training and have a permanent duty station.
Get your child, live off post, the child will be your dependent, get medical, dental, care. On post child care is available! You receive monies for room and board, outside of your twice a month pay check!
Too, you learn a meaningful profession, 30 day leave with pay every year, promotions and can further your education!
What does all this cost you? A four year enlistment!
Forget him, move on with your life! Too, with you in the military,
you do not have to worry about ANYTHING negative from him!

No matter where you live, you should NEVER have to pay to get what's owed to you and your child from a deadbeat parent. If they ask you to pay, go elsewhere. If revenge is your thing, take comfort in the fact that if he dips down below $10,000 in back child support, he'll be going to jail for 90 days out of each year that he's in the hole.

Contact the local Child Support office. They will go after him and enforce the court order. Ask them about when you can file.

Not sure about your state, but in PA, if he cannot prove that he has at least attempted to make contact with his child for the last 6 months, you can file abandonment.
Good luck!

What outcome do you expect from going to court?
Are you seeking to terminate his parental rights?
Why are you waiting - how will that improve the situation?
No money and no contact for 5 months - file now.

This should be everything you need to know about the laws in MO.
And apparently the people who enforce child support do it for free.
