I applied for a job (unifor city) and to make it short I was hired pending my drug test and background check,anyways I called to check how things were going and the manager goes "Unfortunetly your unhireable because you have a criminal history".I was stunned I have NEVER been arrested in my life,so then I thought maybe someones stealing my identity,so I paid to get a national criminal check and the slate was crystal clean like it should be,So I called back and I asked the managaer where he was getting his sources from what data base he was using so I could se for myself,well he wouldnt tell me, so then I asked for a copy of my record he said he couldn't,legally were do I stand this is preventing my hire,does he have to give me his sources?what do I do?

Do you think my juvenile record could cause this???I dont see how,this job isnt some like big government agency or anything,this is just a reg. normal job and there just doing a national background check not no big FBI fingerprint check...I think that juvenile record is irelevant right?

I beleive you have the same right that jerk has to obtain your own record. go to the dept. of records at the police dept. or at the county recorders,anyways it is possible to get this info I got my own print out of my history so you can get it. Once you have this info from the gov. take it to that place that you applied at and show it to him followed by telling him you're going to report him and his company to the labor board.Do it report him or else he will just keep discriminating people and using the same excuse thinking people will just give up and walk away.put a stop to his B.S. its slander against your character and asainst the law,and to falsify that info cause it sounds like thats what he's doing!You must take action it will only take you a few minutes and the damage to him and that company will be tremendous and worth it for yourself and others..good luck!

If he is using this to turn you down for the job, he is very stupid. That is against the law to lie about a background or criminal check. I don't know if the law says they HAVE to show you your report or not. That would be set at your state level, I would think.
I wouldn't even wonder about it any longer. I would call the person above the person you spoke to on the phone. I would state your situation and listen to the answer. If that doesn't get you an answer I would hang up and call an attorney. Then sit down and document this entire scenario exactly how it played out from beginning to end. Go see the attorney and let him/her read it and you will have an opinion in less than ten minutes.
There is something here that is not right. People don't lie as this person did and get away with it. You should have received a letter stating you did not get the job too. The only way I can possibly think this could have happened is IF they a did a nationwide search and you did not. I have seen that happen. Very interesting situation you have there.....................

A more important question I think would be; do you really want to work where there is such incompetence?
My personal philosophies aside, I would suggest running it by an attorney who would be more famiiliar with the particular legal issues.
Apparently depending on how the background check was done, you may or may not be entitled by law to disclosure of the information obtained. Which is quite stupid as it would be information which supposedly you already know about yourself.

It may be that the manager just didn't like you and had no other legitimate reason not to hire you, but there are better excuses than a criminal background check. You may have a case for discrimination. Though my philosophical opinion is that employer/employee relationships are strictly "at-will" meaning that both retain full rights to make any decision they wish regarding that relationship, including being discriminatory or terminating that relationship based on personal feelings. But that's just me.

For starters you should go to your local police (or county or state police) and get a certified copy of your criminal history. You might have to pay for it, but at most $35. Reason being that private companies such as LexisNexis are not 100% accurate. Other internet websites are even less accurate. The only way to find out what exactly is on (or not) your record is to do it through a government agency.
After that it is a matter of clearing up your record, if there was a mistake. Or reapproaching the employer or the state labor department.

He is lying, he just does not want to hire u.
Guess u better go apply elsewhere.
There are cruel folks out there like that.
Guess if u did have a criminal record he may have really hired u.
It is a really messed up employment world out there.
U will live and learn.
Dont get discouraged, u dont need to work with jerks like that anyway.

Yes, it sounds like he's making excuses for not hiring you. The law states that you have the right to any records the employee uses to discover your background.
You should send a certified letter demanding a copy of the records he's using, or let him know you'll be filing a complaint with the equal opportunity board. Then do it, if he doesn't comply.

My current job did background checks as well. One guy was turned down because he had a ticket for throwing a cigarette butt out the windows ( litering ) in another state. he forgot about it and it never got paid.
Its not only issues from getting arrested. You can check your own criminal history. After his experience I went down and got my own printed out. cost me like 8 dollars or something like that but it was nice to see that it was clean.
You have to go to the proper goverment agency office and get one.

There is a record of it somewhere. Someone someday somewhere will find it. I would be honest about it, especially if it was a few years ago. It might make you iffy on the security clearance. Hiding it and it coming out in the future could lead to a security clearance being revoked and a discharge though, so... up to you.

Ask the employer to check and see if their record of your social security number is correct. The same thing happened to a friend of mine and the employer inverted 2 numbers when they interred his social security number. They never checked to see that the social security number on the background check matched his name (stupid oversight!). Good luck, hope it's something as simple as that.
