My great uncle called my parents and told them there was a saftey deposit box in my grandfathers name, his brother, that was in a local bank. My grandfather passed away about 7 years ago and everyone thinks he was murdered by my uncle, who is benefactor of the will. When we heard of the box we went to the bank and they said we couldn't open it unless we were executor of the will. My great uncle was on the saftey deposit box's emergency numbers list. Is there anyway for my parents or my great uncle to get what is inside the box? Is there a statute of limitations on wills? This all happened in north carolina, any hekp is appreciated.

Well we do have concern that he was murdered but my uncle is in the law enforcement community so that may be a problem. Its also been 7 years. Is there anyway we could have the body exzumed? And whats the likely hood that there would still be enough evidence now? Its not always like csi. Of corse proving that my grandfather was murdered is my top priority but it seems like a never winning battle.

I don't know about the law in your state. Do you think there might be some information in the safety deposit box about your grandfather's dealth? Maybe he knew something might happen. That may be the reason your uncle does not want you to see it. I don't know but Good luck.

You guys seem a little more concerned about the safety deposit box than proving that your grandfather was murdered. Where are your priorities?

Was the will probated? If it was, you will, at the very least, have to go back to the probate court to obtain new letters of administration. You may need to obtain an order for the bank to turn over the safe deposit box.

After a certain period of time the bank is required to turn unclaimed property over to the Secretary of State. Check the unclaimed property division of your Sec. of State. You can usually do that online.
