The urn should stay in whichever country has won it. It is in Australia now, it should stay here. If the MCC wants it back, all they have to do is beat us in a Test series. What could be easier?

While logically the Ashes Urn should be given to the team which win the series, the Ashes Urn is not being given to any team due to following reasons:

1) The Ashes Urn was presented to England Captain Ivo
Bligh Melbourne Women during England's 1882-83
tour.

2) Ivo Bligh considered the Urn as a personal gift to him
and handed over to MCC for keeping in MCC Museum

3) The practice being followed since 1998-99 Ashes series is
that a Waterford crystal representation of the urn has been
presented to the winners as the official trophy of the series.
amnd the Original Urn is always kept in MCC Museum
and never given to any team.

Well you could argue that as Australia never declared independence it doesn't matter where they go, or still, that as they weren't owned by Australia before they were burnt, technically they remain the property of the owner.

It doesn't make much sense on a competition level, but then not many traditions do.
