You will be fighting an unwinnable battle and in fact, any attorney with experience in that area will tell you that...be very wary of attorneys that claim to be able to win against the military and the VA in these matters. The disability payments will only be paid from the time of the rating "AFTER" discharge and "AFTER" the award letter has been authorized.
I am a veteren with a 10% disability rating since 1992 for injuries that occurred in 1981, 1984, 1989 and 1991... The payments didn't start unitl after the actual award in 1993.

I was injured in the Navy in 1988 and I filed for disability in 1994, 2 years after my discharge because I was unable to work due to the progression of the injury and I was awarded a 20% rating in 1997. I was compensated from the time I filed for benefits up to the current date of approval and a 20% rating is what's needed for full medical treatment at a VA medical facility. To my knowledge you cannot "sue" the military for compensation for injuries. That's what the disability compensation determination is for.

Contact a Representative at the American Legion.They will only pay you from the date you filed a claim.My dad tried 5 times to file a claim.I finally got it for him through a Dr. connection.He waited almost 60 years for service connected benefits.He received a lump sum,for the year waiting for them to except his claim.He received 2 years of benefits,then died of asbestosis and pulmonary complications.We lay our lives on the line daily,and the government screws you till our death.I'm glad the people make the country and not the government.

Who told you that you can sue?
If you're talking about military back pay, file with your service's Board for Correction of Military Records. Not a chance you'll get it, but good luck.
If you're talking about retroactive VA pay, when did you file the initial claim? 1975?

You can't sue for injuries suffered as a result of military service. There's a little thing called the Feres Doctrine that will get in your way.

sure, you can sue anyone, but winning and then getting what your owed is a totally diff story.
If you got the money, time, and stick to it ness. Givem hell
Not enough people give them hell after they get blowed off.
But its the government, and the military, they can fund and lose all the paperwork on anything without repercussion

usmc_pipe 'best answer'.... 4.discuss with a lawyer who regularly fights with the government thru the courts....sometimes he can pick-up the phone and get a same day settlement...which only costs 25% of settlement....do some research
