His boss lowered his wage to $12 from $20 per hr. He lives in California, is this legal?

Not firing him was the mistake. If a druggie is involved in ANY sort of on the job accident while the company knew they were a drug user they would not stand a chance in a law suit.

As an employee I would file charges with the DA. You should not be forced to work with a known drug user. The employer is creating an unsafe environment, and to knowingly do THAT is illegal.

As far as wages...it is legal to lower wages as long as they are not below minimum wage (7.50) unless there is a signed contract stating otherwise, either with a union or with the employee themselves.

Sovereign_carrie has the best answer so far. If he is not a legally qualified medical user then the boss can do just about anything he wants as a result. It may be stupid, but it is not illegal.

If the guy has a medical marijuana recommendation and qualifies as a medical marijuana user, then the boss cannot punish him.

It isn't too terribly difficult to get a medical marijuana recommendation in California. I recommend he does that. It won't do him any good now, probably, because he has gotten himself into this situation before had it. But it would protect against future problems of this type.

He needs to refer to the particular laws in California regarding this. If he has a prescription, I don't think there's anything the boss can legally do. He should probably contact the labor board to find out what his rights are, ya'all got some crazy hippie laws so it's hard to advise without living there. I'm pretty sure it's not legal for the employer to reduce wages if the employee has a prescription and is not obviously stoned at work.

To the people saying this guy should be fired, the guy is in California and medicinal marijuana is legal. If he has a script, then it's legal for him to possess and use marijuana. It'd be like firing someone for failing for narcotics when they're on oxycontin with a prescription for whatever reason.

The boss could have fired him so maybe he should be glad to have a job at all. But NO i dont think its legal.

Of course it's legal. He could have fired him. $12.00 is well above minimum wage. Why would you even think it's not legal?

that is wrong but it is up to the employer whether or not they even keep the person employed.
Most employers would fire the person on the spot.
