I've already pointed it out to him along with his bramble bush that ruined the pebble dash on the front of our house. He's done nothing about it and with the bad weather here, the rain from his gutter is pouring on to our front step.... it also keeps us awake at night and really, how many times do you have to speak to someone about this kind of thing. If it was the other way around, we'd have sorted it by now. We stay in bought houses, not council rented ones, otherwise I would have been able to complain to them at least.

If your neighbor's negligence is causing damage to your property or disturbing your peace--which it is doing both--you can contact a lawyer or take him to small claims court.

Perhaps if you get a lawyer to send a letter, he'll get the message and fix it before the issue goes further. Usually a notified letter with a law office name on the letterhead gets people's attention.

If you have home owner's association, you should start there.

If not, there really isn't you can do, provided the structure and damage is contained in his property. You can't fix his problem and send the bill either.

You could sue him but it will cost you so much money to do it, EXCEPT, you could say, his damaged gutter has damaged your front step (is it damaged?) and sue him in small claims court.

To do this, identify the problem (sand drained away?) and hire someone to do the job, and have him bill you. This way, there IS an actual monetary damage. Then sue for this amount. If you do it yourself, you really can't do anything.

Keep in mind, in small claims court, you can ONLY sue for the actual monetary damage. Disturbing the peace, such as noise, is for the higher courts.

Yes, it's not fair, but that's the way law is written.

You are probably only talking about £100 - which is a small amount when faced with never speaking with your neighbour again if you take him to court - so just get it fixed & if you can recoup the cost back - so much the better. If it stops upsetting you that's got to be worth something??

best way to stop it is cut the gutter then fix a external stop-end in he's gutter and yours.then lift he's gutter an inch and it will back-fall towards he's garden.let him sort it then its he's problem.

Id have the man arrested and sent to his death...... come on im sure its not that big a deal in the schemen of things is it - If its such a problem to you botht then I would suggest you pay for it out of your own pockets as it seems like the neighbour has taken the stance of im not bothered - I dont blame him
