I went through a lot of trouble with this particular apartment I was planning on moving into but I went tthrough it and I moved in on New year's eve. Now, I'm finding out that the shower will only have enough hot water for 5 minutes so after 5 minutes the water gets cool instead of hot. I called the landlord and he said it's because it's tankless so it only last 5 minutes and I have to take a quick shower. I asked him if he can install a water heater and he said no. He's not going to waste $1000 to install just for me. I commented that the other unit has it and he said that the other unit's tankless heater was broken so he had to replace it.

Anyhow, I don’t think I can stand taking 5 minutes hot shower since I live in MA. What are my options? Can I sue him and make him install the heater or can I sue him and get back my first and last month rent, my moving expenses, payment for the hours I spent cleaning, and for moving cost to another location? Or am I out of luck...

Unfortunately, your apartment, your problem.

You can sue -- we can sue for anything here.
The suit will cost you, but at least they can, in "legal-speak" tell you -- it's your problem, the landlord has met his obligation in supplying you hot water.

Once you allow yourself to recognize the issue, then you need to take proactive steps to correct the problem.

Some ideas:
- low flow shower head
- adjusting (if adjustable) heater to heat for a longer duration..
(check water heater make & model then check mfg'r website, or post the information here on Y! Answers -- someone might be able to help you with it)

First of all, a tankless water heater should never run out of hot water. Hence the "tankless" part. A tankless water heater was made to supply continuous hot water on demand without ever stopping. The only thing that would affect that would be another fixture or apartment hooked into your water supply. I would first read my rental agreement and find out what kind of maintenance policy you have. Then find out if MA has a fair housing commission like we do in California. If you are paying rent your apartment has to be up to standards. If you pay to have hot water than you should have hot water. Good luck.

BREAK THE FREAKING WATER HEATER! Well, even if you did that, he'd just install another tank less water heater. He must be the one paying the water bill. I guess you will have to live there till your lease is up. Start looking right now for a new place, so when your lease is up, you will already know where you're going to go. Your Landlord sounds like most of them.. A real piece of work.

In Oklahoma, we have a Landlord and Tenant Act which spells out responsibilities of each. Try checking online to see if MA has the same. As a Realtor, I'd think that a landlord would have to disclose up front. Also, how could you sanitize dishes in the dishwasher or wash a load of clothes with five minutes hot water? Worst case, have a plumber install a small electric one.

Most models of tankless or, "on demand" water heaters have duration timers on them. This is to protect you from burning up a lot of energy in the event of a broken water pipe. Try this. Look in the manual and see if you can adjust it on the model that you have. If you don't have a manual then go to the manufacturer's website and download it. It may be a simple matter of turning a knob or screw or pushing a button or two. This would save a lot of trouble with your landlord.

Where I live, I not think the Landlord has to do much of anything other than try to get the Rent. You may try calling the local Prosecutor's Office and ask about your legal rights. We called the one here about a New Car my Niece bought and he was very informative as to what her legal options were.

sue him. you need to ake pictures of all that you claim wrong. be sure to get the story strait to your lawyer when you present it to the judge. if you have a good lawyer you can easily sue the pants off of the apartment complex and the lanlord.

Didn't you check out the place BEFORE you moved in??
I'd say bad luck buddy. You can ask the l/lord to install a new heater BUT.........if you don't like it ....move out.

THERE HAS TO BE A HOUSING COMMISSION SOMEWHERE .......CALL OR WRITE OR E MAIL THEM WITH YOUR PROBLEM- YOUR LANDLORD IS BREAKING THE LAW.........YOU CAN ALSO CALL AN ATTORNEY WHO SPECIALIZES IN HOUSING, SOME GIVE FREE CONSULTS.
