A friends employer has told him he is not entitled to holiday days from when he had 5 weeks off sick is this correct/legal??

a friend had 5 weeks off sick (paid SSP only) his company works on the basis that you acrue 11/2 days per month holiday.
Thay have told him that he did not acrue any holiday pay for the time he was off sick.
Is this correct?

If you are being paid, then normally you would accrue the holiday. If it was unpaid sick or statutory sick pay then probably not.

In the UK, you are entitled to statutory sick pay that is set by the government. But your employer does not have to pay you sick pay at your hourly rate and usually it will be a 1/3 if not less of your normal weekly salary. Your friend is of course entitled to holiday pay but not for the time he took off sick, unless of course he wants to claim this as holiday, which many people do to ensure they get a fair wage when they're sick as it is at the employers discretion whether they pay you at a normal rate while you're sick. However for 5 weeks sick leave they are only likely to pay your friend a statutory sick pay and of course he needs a Doctor's certificate.

It depends on the company's polices. Your friend used 5 weeks of sick days. His company probably used some of his vacation for the sicks!

What does it say in his/her contract?

Hoidays and sickdays are two seperate things!
