New Years Eve. I was at a friend's house. These guys show up and I commented on his tie. He called me a 'Chinc' and a big argument erupted. My friend, owner of the house, told them to leave and they would not leave, but finally did 15 minutes later. They came back and wanted a fight and more arguments erupted. They said someone punched a guy's girlfriend at the previous visit. None of us acted in that manor or saw it. She was not there the second visit. I saw my friend get swung at, and I ran to help him and I got hit in the back of the head by an object and then hit in the face again. My other friend called the police, the police came got the report and talked to both parties. The police said they didn't believe any side and said that the county attorney would be charging us all with assault. I later had to go to the ER from the hit I had taken. Should I press charges? I know who hit me, but my friends said they didn't see who did to the police. Can I win the case?

I did not press charges right away because I did not know what I should/could do at the heat of th moment and I could not contact the Count Attorney because of the holiday season. I am going to do so today... but even though my top 2 witnesses said they did not see anything in the police report, can they still be witnesses and can I bring in another witness who was there and not in the report? Do I need a lawyer? Do I take it to civil or criminal court? I am sorry for my ignorance.

You're very unlikely to win the case unless you're prepared to spend a substantial amount of cash in court. What did you lose in this fight? Are you unable to work? Sounds like a New Years party that got out of hand - some gatecrashers rocked up and caused some trouble, you had a bit of a ruck, someone called you a Chinc.

I don't think it's acceptable for people to make rascist slurs but unless you have a problem with the fact that you have distinguishable asian origins then I think you'd be best to drop the whole thing. You should have pinged the guy as soon as he said that in my opinion; chasing after him now with a piece of paper is only going to cost you money if nobody stated who the person responsible was to the police at the time.

My opinion is that you should drop it and move on.

When the person who hit you used the word "Chinc" this became a hate crime. So yes, you should press charges. Hopefully, they will try to threaten you again and get themselves in even more trouble.

yes you should. you should have filed that very night. the longer you wait the worse witnesses memories get.
