one is a decree that you are separated with intention of divorce and the other is a final decree that says you are divorced

Divorced is final, And legally separated is for two people who may have children and need some time to work on their relationship, Before thinking about a divorce.

A legal seperation means that you both maintain seperate residences and divorce is pending. But you are STILL MARRIED. Some places require a time of legal seperation before the dinal divorce decree except in cases of adultury or abuse. You cannot get remarried while seperated. A divorce is just that. Any legal claim you have onthe other regarding marital property is null and viod.
If you wil the lottery while just seperated, your spouse can claim half of the winnings, but if the divorce has gone thru then they are SOL

I think that legally separated people have to file for divorce before they can remarry but if a couple are legally seperated they are not treated as a couple anymore in the eyes of the law.

Legally separation means that a man separates from his wife by legal decree announced by a court, in response to an application submitted by either man or woman. Divorce means also separation but in this case separation by divorce is under certain terms and conditions embodied in marriage agreement. In the former case (Legal Separation) the wife becomes entitled for certain privileges whereas in the divorce he/she has to forego their entitlements. In crude sense of the word, divorce and separation are one and denotes breaking up of relations.

You are considered legally separated once the divorce papers are filed. You are divorced once it has gone before a judge and it's been signed and granted.

legally separated is just that separated w/out the dissolution. So many people waste their $$$ and time on a legal separation when in all reality the dissolution (DIVORCE) is better. Now you'll have to spend more money to get the dissolution.
