Well, I think the State has to have a Constitution and it's own government. it is up to Congress to determine that the Constitution and the governing body of the State are in order. If it is on order, and the State wants to join the union, then the Congress votes on whether or not to admit the State. I cannot remember if it is a simple majority, or a 2/3 majority. Once Coongress admits the State it is sent to the President for his approval.

"New states may be admitted by the Congress into this union; but no new states shall be formed or erected within the jurisdiction of any other state; nor any state be formed by the junction of two or more states, or parts of states, without the consent of the legislatures of the states concerned as well as of the Congress."

Uhhh... States themselves vote on whether or not they will choose to be part of the Union of States... Some of us are old enough to remember when Alaska and Hawaii did that.

CONGRESS has "the ultimate say-so" over annexation of a new state into the union.
