So my boss is trying to pull something fishy with my overtime hours. This is my first job ever I worked about 95 hours over the holiday season and hes trying to say i only have 2 hours of overtime? HOW IS THAT POSSIBLE? I know its not but i want information to prove to him that he is wrong. PLEASE HELP ME, websites would help so I can print it and show him. I also need info on how long of breaks i can take and if he is allowed to take away my hours for breaks? ANY INFO WOULD BE GREATLY APPRECIATED!

Okay first, How can you prove you worked 95 hours? This is the part that truly stinks most of the burden of proof will be on you. Do you clock in at work? If so ask to see your clock in sheet. I know this is probably not exactly what you want to hear but like I said burden of proof will be on you. Also a normal 8 hour shift day, you should have at least one 30 minute (lunch) and two 15 minute breaks. But it can also be a 9 hour shift with a 1 hour lunch and two 15 minute breaks, it really depends.

You need to talk with your boss. I had this one boss who was really spacey and always had the wrong hours. It could just be a mistake. Before you talk with your boss write down the days and hours you worked. if you worked 5 hours a day, you get 15 min paid break. If you work more than that you get 1/2 hour unpaid break. this is for michigan, it may be different for other states. also, overtime is anything over 40 hours a week, and it depends on when the week starts for your place of work. I worked at a day camp that was mon-fri but the work week was thurs-thurs. also, your paycheck is often for the previous 2 weeks, not for the week you receive your paycheck. find out all this from your boss and If you think he has your hours wrong tell him! you worked, you should get the money.

look at local government websites about job laws in your state for info on overtime, holiday pay, and paid breaks

Do you have an electronic timeclock, or do you still have a punchcard? If you have an electronic timeclock, it'll be documented (even if he tries to change it, it'll show up as having been changed). If you have a punchcard, get a copy - your manager can't refuse you access to your own records. If you just show up and work, then you're really out of luck.

And you said you worked 95 hours over the holiday season - but is that more than a 2-week period? If it is, then you really might only have 2 hours of overtime.

Any day you work more than 8 hours you are required to take at least a 30-minute break (unpaid). He can't take away an hour for a break if you already took it.

You need to keep a written log of your hours, for your own personal records.

If you're clocking in with a manual time clock, ask to see the time card. If it's electronic (like on the computer) ask to see the printout of hours. Are you clocking out for a lunch break? Did you deduct that from the hours you worked? If you're talking about working 95 hours in a 2 week period, let's say you worked 6 days each week...so take out 12 hours for lunches in a 2 week period and you'd be left with 83 hours. Take away any time when you came in late, and 2 hours of overtime is possible.

I used to be a store manager, and there were many times that someone came to me and asked why they hadn't been paid for all the hours they were scheduled...forgetting about the days they were late or called in sick. I never made a mistake with the payroll, but I've had it happen to me other places, so I know sometimes employers do make mistakes, and often it's accidental. If you have kept track of all the hours you worked and you take your calculations to your manager and ask to see your time sheets, most of the time if they realize an error has been made, they will either cut you a check on the spot, or add it to your next check.

well first of all for any eight hours u work you are alowed 2 paid fiffteen min breaks and 1 unpaid half hour lunch as for him taking hours away wat u do is each day u work u keep a book with the time you punched in and out and you have a member of managment sign it and when you are done for the two weeks or week how ever u get paid u add up the hours and account for the lunches that u take as well and if they dont add up to what hes got then u have him by the gonads. if he is skimming hours from u u can call the national labor relations board wage and hour division and report him cause thats a federal crime.

Is there some way you can get a printout of the hours you did work, the breaks you took and how long they were for. If so that would help you bigtime. Other than that Im not sure what else you can do, unless you have co-workers that can verify that you did work all that time.
If this continues or he dont wanna make it right for you....Just quit...there are other jobs you can do.

you worked way more than what is needed because the holidays are suppose to be a time to spend with your family and not to stress with work
i think your boss is a dumb fatty so you should get next paycheck and quit haha well hope you have a good life and solve this problem

if he takes out for brakes it's usually just for lunch. you need to write down your hours. ask for a copy of your time card. if he is ripping you off, tell him you want your pay, if he says no. go see a lawyer, report his butt.
