I have a baby with the man I am currently with. Things have been kinda rocky lately. I am from another state, and may end up leaving. He told me that I could not take the baby with me. That just because I am the woman, does not give me the right. What steps need to be taken to be on the safe side?

your probably smart to have not gotten married otherwise you could not leave the state for 90 days after a divorce has been filed. When you gave a state/government marriage it is a contract that you inter with your husband and makes you a slave to the government.

Since you never went into that contract, I think you can do whatever the hell you want to. However he could come find your child and take them wherever he wants as well.

This depends on some factors.
Were you married?
What state do you live in and their laws?
If you were never married and their is no court documents stating that you can move with 100miles or so from the father then yes you can go out of state in Michigan.

see a lawyer.. most times 1st visit is free. if he wants to stop you he can with a court order. then the courts have to decide. best bet maybe get on his good side.. and set up your visitations with him and stuff and talk about the move with him.. if you cant a lawyer is best way to go.. if your leaving state for work or your safety from him it might be different.. good luck

If you were really concerned about safety, you would consider the emotional safety of the baby. A child need BOTH parents, and to think about sneaking out of state to deprive BOTH of them developing a relationship as Dad and Daughter or Son, is truly selfish. I hope you sprang your ankle or something you bitchhhhhhhh!!!!!!!!!!!!!!!!!!!!!!!

he is the father and he has rights and i agree with him the child doesn't only have one parent he has two the courts encourage couples to come to a agreement but you are not suppose to take the child more then 100 miles away from the other parent

the only thing you cannot legaly do is leave the country with your child with out the other parents concent . you could go to jail.

as long as your not leavin the country. go for it. leave the bum. theres no point in your staying if your not happy :)

If you were not married to him at the time the baby was conceived / born, he has no rights whatsoever. You can take your child wherever you like, without having to ask anyone's permission. Him telling you you can't is just his pathetic attempt to keep control over you. Do not fall for it.

Are you married? If not, then has paternity has not been established (and if his name is on the birth certificate, it has)? Is there a custody order in place?
