I have copies leases w/ our names, i have a noted calendar w/ all arguements confrentations & promises made & broken I've carried our kids on my health ins. until this year, I do all, incl. being a daddy. I have put up w/(don't ask why)many other women & have pics, notes, & old hotel rcpts pertaining to him& these women, i have been told yr after yr that things will change & we would marry(i've NEVER pushed or nagged that topic)was told that all is wrong because of me"2 manly 2 fat 2 shitty 2 ugly," im ugly when he talks to me crazy,this has been ongoing for @ least 8 yrs(been 2gether 18 our kids are 5 & 1), we have no house(live in 1bd apt)he does stay over at times, he lives w/ his dad, we split bills 50/50, he has a navigator, a truck he's fixing, a bbq truck & had a vette, he has a reg day job & works as a bouncer/personal security @ clubs, cash under the table. i'm at my breaking point, i want to cut ties & file childsupport & want the max or more. we live in TX. how do I start?

Being as I went to school for paralegal I know a little about the justice system. Though I cannot formally give you legal advice I can say that if it were me, I would find an attorney that doesn't charge for the first consultation. When you go to the attorney take everything you have with you, receipt's, the calendar, anything you have that you can show how he has treated you and the things you have put up with over the last 18 years. If he has lived with you at one point or another for any length of time you may be considered common law husband and wife (I think some states still recognize common law marriages) and may be entitled to other things aside from the child support. Just do it. As long as you can prove he is the father than he is responsible for taking care of the children, but then he would no longer be paying 1/2 of your bills. And if he is getting paid under the table, it can be hard to prove, therefore not gettable.
Child support nowhere near covers what it cost to truely raise a child. And you pay up until they are 18 or out of school (graduated).
Right now they figure to raise a child from birth to college is $160,140. (add more every year) You figure an average child support payment for minimum wage is at $40-$60 a week for one child from 5yrs of age til 18 = $27,040
Thats alot of extra money coming out of someones pocket. (like $133,100.)
I guess what I am trying to say...is when you truely sit down and add it all up, will never add up to the amount it cost to raise them for their everyday needs.
But it is good that you want to stand on your own 2 feet, there are alot of std's out there, and you are much better off. Go to your Friend of the Court and get the paperwork to file.

I really feel for you. 18yrs and he's still a jerk !! I would suggest that you seek out some legal aide. We have it in Australia but l am not sure about where you live. Hopefully you have a free legal service where you can get all the help you need and it won't cost you a cent. He sounds like a very selfish, immature man and you will certainly be a lot better off without him. Best of luck to you and your children. Happy New Year.

The first thing you do is see a lawyer and tell them everything and give them everything you've saved through the years.. Try to find out who the nastiest, meanest, cruelest, son-of-a-bi*ch on the planet is, and hire them. Tell your lawyer you want his balls on a platter and ask how much that will cost. Tell the lawyer you want everything he has, the highest child support you can get, you want his car, his guns, his toys, his stamp collection, and anything else worth anything. Tell him you will even take his underwear if the courts will give them to you. Tell him you want full custody of the kids without visitation. Do you see where this is going? Ask for the moon and you might get what you deserve. Don't back down on anything unless your lawyer says you have to. The first time he comes around to try to talk, get a restraining order. Good luck. You will need it.

just get some legal advice quick smart and be done with him, get on with your life. You have already given this man 18 years of your life don't waste another day with him. There are better men out there who will treat you sooo much better. If he really loved you he would've done the right thing and married you long ago, if you know there are other women, your letting him get away with it by staying with him. He knows clearly what he's doing.

contact a legal aid source in your town where you can receive a free consultation with an attorney that is experienced with these kinds of cases.I dont know about in tx,but here in fl(where I am currently going through a similar situation) you can contact your local children and families center and they can give you the proper contact information to receive free or low cost legal advise.Try contacting your local court house to see if they can give you any contact information for free legal help if you dont have a children and families or H.R.S near you.Best ofluck to you with this one!

start with a lawyer... and a good one.. have lawyer make him have to pay for it too. yes get away.. he dont want you or he would be there. he wants to do his things when he wants and have you when he wants.. as far as how much you get that all depends on how much you both make.. its based on that.. so more he makes the more you get..dont take this from this man no more.. and you will be fine and get on your feet and find you will feel like a weight has been lifted from you.. good luck

CONTACT THE DOMESTIC RELATIONS OFFICE AT YOUR COUNTY COURTHOUSE & FILE FOR CHILD SUPPORT. YOU SHOULD BE ABLE TO DO THIS WITHOUT A LAWYER. I KNOW YOU CAN IN THE STATE OF PA, BECAUSE I HAVE. THEN CONTACT A LAWYER TO GET CUSTODY OF YOUR CHILDREN. MAKE SURE YOU HAVE YOUR PATERNITY PAPERS SINCE YOU ARE NOT MARRIED. GOOD LUCK!!!
