father and she would like to take a DNA test. My question is ,in the state of Indiana, would he be required to pay back support for the previous 16 yrs. or would support payments begin after paternity was established

It would be wrong in so many ways if he were to be responsible for paying for a child he didn't know existed. If the mother didn't care enough about the child to know who the father was, then she doesn't deserve a single penny. I would definitely have him seek out some legal counsel, get the DNA test done ASAP. If it turns out he is the father, hopefully he can have some kind of relationship... even though I can't be sure what the mothers motives are, waiting 16 years and then telling her she 'thinks' her father is your brother.

If I were your brother, I would seek the advice of an attorney regarding contact with this child. If he is the father then he would likely be liable for child support until she is 18 and still in school. She may not be his child, but if she is then he should take responsibility but not necessarily establish a relationship if he does not want one.

No, he shouldn't have to pay back support, however if he is the father he may have to pay until she is 18. He should contact an attorney to see what he has to do ( does he have to submit dna ? ) and what he doesn't have to do.
