Does having an LLC protect the trucking company even if the owner is the only driver? Wouldn't someone just go after the driver personally, which would be a round-a-bout way of getting to the company, being that the sole owner of the company is the sole driver?

LLC is actually the other way around. It protects the owner from any downfall of the company. The owner should have their own personal "pay" from the company that can't be touched incase the company has an issue with a law suit or bankruptcy.

It depends. In an LLC, there has to be more than one owner. Only one owner can be reached personally---so odds are that;'s not the driver. You can go to your Secretary of State--Corporations website and look up ownership type and maybe get some info there.
