pulling out of our driveway there was a car on the other side of th road, but right accoss from our driveway. I looked up the FL state driving book an all it says is
1. Parking is not allowed infront of driveways
2. not allowed in such a way that you block or creat a hazard for other vehicles.
The car tires were about 4" from the grass, but it was a full size car so it was well in the street. Is it all our fualt or half or none.

florida is a no-fault state so it doesn't matter

Not so sure about in FL but here the parked car is a non moving vehicle so you would be at fault. Also you were backing up meaning you did not have right away. Meaning you were also at fault. When they say right in front of a driveway they mean like if it was blocking YOUR driveway, not being across the street from one. If you honestly want to see who would be at fault you can send the report to the insurance commissioner. They would tell you.

The person backing out would be at fault in your case. By "parking is not allowed in front of driveways" they directly in front of a driveway, as in on the same side of the road. Also, to park on the side of the road, where it allowed(i.e. in neighborhoods) autmobiles must have their tires within 12" in the curb, or roadside. Also, vehicle may not be parked on the other side of the road if there is already a vehicle on one side of the road, except where lined parking spaces are already marked.

It doesn't matter if the other car was parked legally or not. You hit a parked car. That is your fault. If it was parked IN your driveway 2" behind your car, you still don't have the right to hit it, although you could have it towed in that case.

The insurance companies have a simple rule: if you hit something that isn't moving, it's 100% your fault.

It doesn't matter if it shouldn't have been there, or if it was violating any local ordinance - it wasn't moving and YOU hit it! Who else could possibly be at fault? It's not like the car leapt out in front of you...

You hit a parked car not directly blocking your driveway. So yes.

Unless there are other circumstances (it's a one lane street, something else), it is your fault. Could you have driven around it if you had been more careful?

I think that maybe it is your fault. Like someone has pointed out you were moving and the other car wasn't. Be more carefull next time.

You can't just go around hitting cars, even if they are blocking you. That's why you call a tow truck. So yeah, it's your fault.

you were the only car in motion so yes it it your fault. It is your responsibility to be aware of any obstacles in your path even if they shouldn't be there.

the cars fault for parking in driveway.....it is not exactly your fault.
U both are probably at fault.
