HE REFUSES TO FIX MY HEATER AND I'VE BEEN USING MY STOVE TO HEAT THE HOUSE. I HAVE A SMALL CHILD IN THE HOUSE AND I'M CONCERNED.

I am a landlord. You have the right in our state to fix the heater and deduct it from the rent by sending a COPY of the receipt with your next rent payment. If your landlord has not fixed it in a reasonable amount of time. I would send a letter retaining a COPY, stating the date the heater broke, the number of calls( with dates)you made to him/her reporting the heater failure and a final request to have it fixed in 48 hours. I would also tell him/her that you need compensation in the form of rent reduction for the higher electricity bill you incurred attempting to heat your home. If it has been below freezing at night this is a health hazard. You are entitled to stay in a moderately priced hotel at the landlords expense till the heat has been restored. The law may vary from state to state. Please search "tenant/ landlord rights" for your state. KEEP COPIES OF EVERYTHING, should you end up in small claims court at some point.Good Luck

I currently live in a rental unit that windows wont open, no screens so I cant open the windows that do open so I can have cool air. I have a four month old baby and there is mold in the basement. holes in the walls exposed wires and much much more. I don t know what to do I called code enforcement and was served an eviction notice the next day. I have no problem staying here and paying my rent I just want my kids to live in a home where the r safe and can play. what can I do ?

go to your town or city hall and report them to the board of health and building inspector. Its illegal to not have heat in the winter and you could get sick from carbon monoxide even call the red cross or police there may be a shelter or you could go to a hotel and the landlord would have to pay

Try talking to your landlord and sending a letter via certified mail expressing your concerns, so that you have proof of the letter. Then I would suggest going to small claims court to break the lease so that you may move elsewhere.

you can refuse to pay rent, call your mayors office and report him. you can al so call your local heath department and report him. if that don't work call codes on his sorry but.
