I recently sold a laptop on ebay and sent it via usps insured mail. Buyer got it and it was damaged. Instead of going through usps insurance, they are demanding I pay them for repairs! If I want to go through usps, they wand a full refund and then they'll send me the laptop to get my money back. Also, if I do not pay the 50 dollars repair in the next day they are going to file a claim with their credit card and paypal against me. I am new to ebay. I am wondering what to do, I figured it is usps problem for damaging it, not me! And the buyer is just refusing to work any other way than direct money from me to repair it, claiming usps will take the the laptop for months until a refund is done and that only I can get the refund and only i can take in the item. Of course I found out the buyer can take it in too. What should I do?

The buyer has even threatened me with an attorney in case I do not send money immediately. I have tried to reason with the buyer, stating it is not my fault or theirs, but its always the same response, I owe them money, they dont want to wait. The laptop works, just has some speaker dents and a small crack on bottom, suprisingly the buyer sent me photos. I think the buyer just wants it paid for now by me instead of waiting on usps, etc. I was worried that paypal would freeze my account or deduct the money for a refund or something. Like I said, I am new and this is definately a rough start! And I guess the buyers husband has 'repaired' some of it already for free and they are not charging me hourly fees. I have contacted ebay and they said they cannot file against me, but buyer claims they can, they know the ebay and paypal rules and their lawyer can tell me the rights they have as buyers. The buyer also sells and claims any other seller would have refunded them already.

First, find out the USPS procedure for a refund, so you know what the real story is. If you can file the claim, do so yourself - it's just easier. Make sure the buyer does whatever you need him to do before refunding ANYTHING. Write out all of your requirements or instructions clearly and completely for the buyer and assure him that you will work together to get the problem resolved. While it isn't your "fault", it isn't the buyer's "fault" either, and he's the one with no money and a broken computer! If the buyer continues to be unreasonable, contact eBay yourself. eBay and PayPal investigate claims, so don't worry about just getting banned or anything. They have been VERY good with problems I have had in the past.

Followup based on your additional details:
If the item has been "repaired" by the buyer in any way, I seriously doubt USPS will honor the claim, and neither should you. It has been altered from the state in which it was received. At this point, I would tell they buyer that as they have already make changes to the product, you cannot in good faith place a claim with USPS. You could (as a courtesty) refund the shipping charges or something, but that would be up to you. The attorney threats are obviously a bunch of hot air - ignore them.

P.S. people with buyer's remorse on eBay ALWAYS try to pull stuff like this!

YOU DO NOT HAVE TO PAY FOR REPAIR, being that it's the postal services faught. If there was insurance, they can collect the money by filing a claim at the post office.
Negative feedback will not make your sales decrease!

Ask them nicely to send you the laptop by UPS Ground and give them their money back (Including the UPS Ground shipping costs)

NEVER USE USPS to send laptops or any other electronic devices.

Once you have the laptop you can solve the problem with USPS.

If you don't fix this quickly you could be arrested for fraud by the FBI.

tell them that you do not pay if an item is damaged and if that doesn't work pay for it than if you sell any thing else tell the buyer a head of time that you don't pay for any damage and you Will have learned your lesson

Its usps problems.
Insured and thats what insurance is for.
as long as postal service will handle claim -they are obligated to go thru postal service and ebay knows that. you aren't on the hook. Postal service is...

contact ebay and let them know before hand....
