I leased my home to the builder of the home, he sold the business to another guy. The guy sublet it to another person. The new tenant has paid my tenant the rents but I have not recieved anything. How do I evict them? Also the person who now owns the company is a Designated Broker. What other steps can I do to get my rent?

1.According to the AZ Landlord Tenant Act. (you may recv a free copy by contacting the Secretary of State of AZ.

Read your rental agreement, determine who is tenant & when rent is considered late.
2. Serve the leaseholder a 5/10 day late notice of unpaid rent.
3. When 5th day expires of the notice.( best to serve on door and certified mail. Keep all copies of correspondance in the folder for that particular rental property.
4. On 6th day file with local justice office or court eviction proceedings.(will take as many as 10 days. You may represent your self. )
5.Have tenant served the eviction notice. Goto court and bring your documentation to the judge. He will make determination.

This is easy, just go to the court house in your county, they will have all u need, paperwork, rules, the cost to u for eviction, u will be able to get all the forms u need and all the laws to go by for the eviction, it may take some time but if u do all as requried u will receive ur eviction granted and end this problem once and for all and 07 WILL BE A BETTER YEAR! p.s. DEVILDOG GAVE U GOOD ADVICE TOO! But u can believe me on one thing u will win in court, just 1 question can a resident in ur state file a paupers advidavit? if so it can slow down the process, but in most cases they r not aware of this and yes keep all ur records as DEVILDOG stated.

You should consult a real estate attorney that handles tenant/landlord relations. He/she will guide you through the process. You should have all pertinent details such as copy of lease agreement.
