In general, the provisions of your will control. Most states have provisions that protect a surviving spouse & those would come ahead of the will; the will would probate the remainder. Moreover a pre-existing divorce decree or settlement agreement or even an earlier pre-nuptial agreement may limit your right to dispose of property. You should certainly consult with an attorney about theses issues when contemplating re-marriage and should probably make a new will after the re-marriage.

Not unless you named her as such. You should have your Will redone if you have it with your ex-wife as your beneficiary or if you want to change other things. Your existing Will is the document that will be used. If it's old and needs updating, invest a little money and get a new one drawn.

You can always void the original by expunging it.
