New batteries should always be charged at least 12 hours before using them regardless of what the battery indicator says. Follow the manufacturers recommendation for new equipment. If you are still having a problem, you'll need to either contact HP customer support or bring the laptop back to the store you got it from. The battery may be defective. (Wouldn't be the first time!) You should be able to have the battery replaced under warranty.

When you restart the computer there should be a way to enter the BIOS screen (usualy F10 or F12 key). In the BIOS there should be a recondition battery option, try this first, it could be a simple conditioning problem.

This is why there is a manufacturer warranty. You have to call HP if you suspect there is a problem.
