What I mean is who decided what rules to include? Was it the builder? A group of citizens? An HOA office at the city? It seems like all HOAs have the same rules, which indicates to me that it's not a democratic process but a commercial one, where the builders/developers create them. Any ideas how they are originated?

When a Homeowners Association is created by the Builder/Developer, the Rules and Regulations are put together in the Governing Documents. Most Builder/Developers use an attorney to set up the Governing Docs. and the attorneys usually use the same sets that they have used in other Communities with slight modifications to make them fit the current application. Once the property has been turned over to the Owners, a Board of Directors is elected, and many Boards set out to modify their Governing Docs. to better fit the needs of the Community. It's an expensive process and requires a vote of the Membership, but it's well worth it.

It varies from group to group, of course, but generally it's a democratic process - the majority of the people in the HOA vote on them. In some areas, the rules have to be affirmed by a local government agency (housing authority or council) to assure that they pass legal muster. Sometimes If it's for a new development the builder/developer may write the rules, but they can be amended.

There is a council and a president that make the rules for each community, they should be elected by the residents.... and they usually have meeting every so often
