Please help she wants to come to the funeral but doesn't want to be arrested especially in front of her kids.

It's credit Card Debt and she tried to make an arrangement but they were unreasonable - as far as I know no court appearances have been scheduled just threatening letters received - she is worried that when they swipe her passport they will take her to the side and arrest her in fornt of her kids

If she's got outstanding debts and it comes to light that she's back in the country then they'll go after her for the money. After all, why shouldn't they? If she owes money to people or organisations, she has no right to withold it from them.

As I understand it debt is a matter of civil law and not criminal law.... therefore she will not face arrest if the debts are for such items as HP, credit cards loans etc. If the debt is owed in the form of taxes such as to the Inland Revenue then yes you can face criminal prosecution. The best way forward is to try and come to some understanding with your creditors through a formal agreement. However, this option seems long gone if she skipped the country..... But I am sure she would not face arrest on entry to the country. Remember half the country is in debt!

As long as she doesn`t open a bank account or anything like that she will be fine. If shes visiting and not staying they can`t do a thing! My friends fled from debts to the usa a few years ago. They are back now and being paid cash in hand. When a debt collector calls they just deny who they are!

you cant get arrested for owing money to private parties or businesses in the states. You could be arrested if you blew off a court appearance about the debt. If you owe money to the government for taxes you could be.

is there a warrant out for her arrest or are the debts a cival matter between her and the people she owes? if the latter if they dont get to know she is back she may be ok if the former she may get arrested

If it is for non payment of council tax etc she could be arrested but then if no one informs them she is back in the country she might get away with it. To be sure you might want to contact a solicitor or the CAB for advice.

There hasn't been a Debtors prison since the early 19th century in England and NEVER in the USA. What country are you refering to? I suspect "Outstanding debt" isn't the problem, I would bet it's INTENTIONAL THEFT BY FRAUD.

as long as they not for electric, gas or water. if they are credit cards, hp, or catalogues she cant be arrested. i have 10,000 worth of debt this way and there is nothing they can do, even tho they been chasing me up for 3 yrs now.
