To any lawyers outhere, my attorney filed papers with the county court. The case settled outside court, but he is passing the filing fees to me plus he is taking 40% of my settlement because he said, because he filed the papers with court it's now considered that we actually went to court. Is that right? To me he should take the 30% not 40%.

whatever contract you had with your lawyer is what he will charge.. doesnt mater if it went to court or not

He payed for the filing fees so he should get those back. If the contract says 30% for filing out of court- then he gets 30%. If you have problems- contact the state bar association and ask for their help. He will not want a displinary action on his record and will follow the terms of the contract. Good Luck

It doesn't matter if the case ever went to court. You pay the attourney the fees that are stated in your contract with him. Before you sign contracts you need to make sure that you read them carefully and understand them so confusion such as this does not occur.
