Most of the stuff on utube isn't copyrighted so no it is not illegal. Now if someone uploaded a full length Hollywood production movie. Then there might be some legal issues.

The site isn't illegal, nor is watching the videos. As already pointed out, there are copywrite issues (and a lot of those are pulled almost as fast as they go up), but those issues are not your problem...it's utube's problem.
