I have lived in my townhouse style apt for 3 years. My nieghbors moved in just over a year ago. One women, her 10 year old and her boyfriend. They are VERY loud, yelling, slambing closet at 4:00am slambing the front door, you name it. They have FAMILY vist them a lot. So last Friday people start showing up withj luggage ...since Friday afternoon there has been three to four extra adults and about three extra kids in the place so we are looking at about 8 people in a two bedroom...I haven't had any piece at all. What can I do? The property manager doesn't give a shi% and the nieghbor just says my family is visiting...people visit for lunch, dinner, maybe a couple stay a night now and then but these people are camped out! Can I take legal action for nuisance, noise, quaility of life? You have no idea how loud that many people can be!!! I tried to talk to her about it and she said on Saturday it is only one night they wilol be gone in the morning, they are still there this morning.

Personally, I believe you should chill. Maybe they are just visiting for the holidays. Were is your family and why aren't you visiting. Or maybe just be neighborly, go over and ask them to perhaps keep it a little less noisy.

You can file a noise complaint with the police. This is only a minor thing and likely won't gain you much relief, but you can get someone to at least notify them that they are being a nuisance late at night. You can also check with your local codes office. There may be a limit on the number of people that can live in an apartment. A code office can notify the property manager as well and perhaps gain you soem peace.

There is a clause in your lease that states that you have the right to "quiet enjoyment" of your apartment. Basically, the clause means you have the right to enjoy the rental of your apartment, while experiencing only a reasonable amount of noise (and other minor disruptions) from other tenants.

Since you have voiced your concerns to the property managers, it is their responsibility to fix the problem. If they do not fix the problem, you are being denied the quiet enjoyment of your rental, which means the property managers are not living up to their responsibilities as part of the lease agreement.

Just the fact that their are so many people living in the apartment of your neighbors from hell is a lease violation alone, not to mention the noise issue. Lease agreements clearly state the number of people units are leased to, and that number cannot be exceeded.

My suggestion is that you pleasantly but firmly advise your property managers that you are entitled to the quiet enjoyment of your apartment, then give them a written notice, listing the problems with your neighbors in detail. If you haven't been already, I would document every time you contact your property managers with concerns about your neighbors, be it in person or by phone. If you give them written information, keep a copy. Make sure you document the dates you contact your property manager, what your concerns are and what you are advised by your property manager.

Personally, I think it's risky to deal directly with apartment neighbors when you have issues with them. You just never know these days. Let your property managers know that if they don't do something about the problem, that you are prepared to take legal action for breech of contract.
