I recently discovered that microphones have been put in the restrooms of the students in my local town. I was concerned on the legality of what the school system is doing with that? Is it legal for them to put microphones in the restrooms at school? They also have survellance cameras located outside the restroom, although not inside. My main concern is over how legal it is to have the microphone in the students restroom?

That's just creepy. Call the newspaper and see if they'll run an article about it. Maybe it'll make people mad enough that the school will have to remove them.

Unfortunately, you have to check the laws in your jurisdiction to get a clear answer. In some jurisdictions, that would be considered an invasion of privacy that should be covered by a legitimate cause. Considering that the school has already taken the step of actually installing the listening devices, it is hoped that they had legal counsel before doing so; otherwise, there will be hell to pay.

In some jurisdictions, listening in on a conversation, recording a conversation or keeping a record of a conversation (whether or not the one recording it was part of the conversation) without the consent of all those participating in the conversation or a court order allowing the same, is against the law. So, in the end, it really depends on the law and jurisprudence in place in your jurisdiction.

Cameras outside the restrooms are perfectly legal because of "probable cause," what with students engaging in sexual acts in restrooms.

Microphones push it though. That is borderline infringement on the right to privacy (Fourth Amendment).

If I'm not mistaken that is a violation of the privacy act. Call your local news media and they will jump on it.

since cameras can't be used, thats the best chose. Fights, drugs, sex, whatever. A good thing IMO.
