If both minors are under age most states do not find a "statutory rape," however some states do. If the male is underaged but engages in sexual acts, sodomy, molestation, or intercourse then he can be found liable for "statutory rape." If it is not statutory rape it can still be considered harassment, sexual abuse, sexual assault, and can be legally protected against or punished.

Technically, the definition of rape is penetrating and oraphis with out permision. So it is technically rape to poke you finger into someones ear without their permision, or anything else.
