Can someone PLEASE tell me why Stan Lee isn't suing over "Heroes"? The concept is the same as the X-Men
Especially since one of the characters went on Leno and described her character as "Wolverine".
Does it have anything to do with Tim Kring (one of the producers)?

I can see why some people would draw comparisons to NBCs' Heroes and the X-Men, but I think they are too far apart for Marvel (owners of X-Men) to sue for any compensation.

I've heard rumors that all the characters in Heroes have been loosely based on some of the X-Men characters, but their are so many different "superhero" characters owned by different companies that its hard to claim any sort of copyright on a "power" or idea.

Overall, I think their are more differences with Heroes/X-Men than there are similarities.

I don't see any similarities between the either the story or the characters from Heroes and X-men. The characters in X-men are genetic mutants who all developed their powers around the onset of puberty and either decided to fight crime or turn evil. The characters on Heroes are just a handful of regular people who suddenly developed powers at various points in their lives and who are all reacting differently.
