Let me explain. In our closet there is a small hatch like door in the ceiling (does not lock), inside is the attic... A few weeks ago I find it wide open, call mangmnt they tell me to call the police. Police come and climb half way up in there and are baffled, because my attic is shared by the residents behind me... Officer suggested I get a gun and have my husband drill it shut the best he could. As the cop was leaving a man approached us and asked if we were missing items from our apt., I inquired why & who he was, he said he was the resident behind me! Management will not tell me if he has the same attic door in his apt. and we have already drilled it shut on our side. I am scared that I am going to walk in on someone in my apt., I believe someone was here while we were out of town prior to finding it open! How can I go about getting out of my lease without hiring an atty. and are there agencies which oversee apts. and their safety regulations, how do I find them? (I live in Texas)

contact HUD (Housing and Urban Development) they will do a federal investigation you can also contact Fair Housing they will help you to know the law and what your rights are.

Put a lock on the closet door and lock it when you are not at home. As far as getting out of the lease - try talking to the landlord or just dont pay the rent and he will send a 7 day notice - then you can move out but make sure you pay him for the days you were there. The 7 day notice says move or be evicted so you can move out and landlord cant stop you or charge you.

I would photograph, or video tape the door thru to the other apartments.
One, so that you have proof.
Two, you know how many apartments are connected thru the attic.

Contact your landlord, and ask to have this fixed. This should have been done before leasing the apartments.

In your contract, does it state the landlord will fix and repairs that need done? This is one of them. Make sure you also do this in writing, with certified mail, for the receipt, as proof that you did this.

If the landlord does not fix this, it would be breaking the contract, in which case you wouldnt be bound by it either.

There should also be some kind of housing authority in your area. Contact them, they would have more information on what you can do.

In most lease agreements, you agree to pay your rent, maintain the apts current condition, etc in exchange the property owner/manager agrees to provide you with a safe dwelling to rent/lease, etc. It doesn't sound like this situation is within the lease agreement.

I recommend that you have an attorney take a look at it and see if they can help you out.

Drill it shut and put a padlock on it and you should be fine. You should take the Officers advice and get a firearm to protect yourself, a 12 gauge shotgun would be excellent, because it won't penetrate walls, since youa re in an apartment.

Depends on how reasonable your landlord is.....you might have to threaten him with a lawsuit....

My suggestion is to weight your options on how reasonable he/she is....and take it from there... sometimes if you just mention how you need to move and that you have found tenants that are willing to move in immediately he might go for that....especially if you mention that they are willing to pay a little more than you.
