every state is different, so look up your state and click on the section you want (child support, divorce, visitation).
depends upon the custody, and all issues are settled in the divorce.

If the children live with you and NOT their Mother,then you have Residential custody and she would be considered the Non Custodial parent and would have to pay you child support and get visitation set up through the court system. I would consult a Lawyer myself to make sure all is legal and NOT sign anything with her or her lawyer ahead of time. I am going through a divorce right now and I believe you should not take the money until it is signed by a judge. Thoughts of having to pay back? Nothing is guarenteed unless court ordered. If there is no papers singed by a judge saying visitation or custody rights then it is up to the parents to work things out between each other. She can keep the child, OR, vise versa until a parenting plan is in effect. Just try to be the first one to turn one in to get what you want!

No she should be paying you child support if you are the one with the child. My sister is in this situation now. Her (soon to be) ex makes more than her and she has the baby with her so he is responsible for paying to help take care of their baby. I am not sure how you guys have agreed upon the support but try to have something in writing- and have her sign it. Do this until you can go to domestic relations to get the child support court ordered.
She is fighting for full custody. If you can please put a custody order in- usually they side with the mother unless you can prove she is unfit. Right now you can make the decisions for the child because you have he/she. Possessions is 9/10ths of the law.

If your wife left the family home without the children and you are right now their sole caregiver than yes you have TEMPORARY custody, untl the court decides who will get custody and who will be paying the child support, she is not obligated at this time to pay you support because there is no court order, however if she CHOOSES to do so she is free to pay support, it is not required though. Her lawyer advised her not to simply because there is no court order as yet and no one knows what that outcome will be.

Sounds like you have custody; but when you go to court, make sure to ask for back child support! She's trying to be slick, and cheat you out of money that she owes you! It may be that she's going to ask for custody, but make certain that you fight her request!

Well tats weird that she pays a man, but I guess your ego isnt that big.
Why cant you guys just agree on 50/50 custody, STOP thinking about how to get back at your ex and think about you kid(s). They love both parents and always will, plus if you keep them away from one parent they will resent you when they are older.
