What are the north caroilna laws and how do you do it fast and cheap? I have a child and no education so I'm going to need some money to help me out at first. Any advice on how to do this so it goes smoothly

In NC you have to be legally separated for ONE YEAR before you can get a divorce, sorry

I don't know the laws in North Caroilna! But you might call the Human service and ask about it. I had to qaulify for free attorney and it went smoothly and fast. From the time I talk to the person and to the time it was all done toke about 6-7 months. It all depends on the ex,courts and so on! Good luck in your search.

If you have a child the first thing to do is to file for divorce, I don't know where in NC to get a "cheap" one you might start with contacting legal aid or local law offices for a free consultation. You ARE entitled to 50% of the marital assets so you CAN use a portion of that to retain a lawyer to have the lawyer begin divorce proceedings and get the ball rolling on child custody/support. Even the BEST of divorces have gliches, NONE of the go truly smoothly.

North Carolina Divorce Laws

Grounds for Divorce.
A divorce in North Carolina can be granted on the grounds that the husband and wife have lived separate and apart for one year. Isolated incidents of sexual intercourse between the parties shall not toll the statutory period required for divorce predicated on separation of one year.

A divorce can also be granted on the following fault grounds, if either party:

(1) Abandons his or her family.

(2) Maliciously turns the other out of doors.

(3) By cruel or barbarous treatment endangers the life of the other.

(4) Offers such indignities to the person of the other as to render his or her condition intolerable and life burdensome.

(5) Becomes an excessive user of alcohol or drugs so as to render the condition of the other spouse intolerable and the life of that spouse burdensome.

(6) Commits adultery.

Residency Laws.
A divorce in North Carolina can be granted when either party has resided in North Carolina for at least six months.

first and foremost since obviously you have access to a computer you need to research some low cost divorce specialists. occasionally, and especially in higher populated areas, they have the kind of back funds to take a 'pro bono' case which means they will do it for FREE. if not pro bono, then certainly at a lower cost. if that doesn't work out research collages in your local area who might have a student law practice, these kids are learning the trade and are often looking for cases like this to practice and gain experience on.

you can also pick up from your local court house a lare packet called 'divorce with minor children forms and procedures PLAINTIFF' these papers will give you directions on how to fill out and file all the paperwork yourself. to do this you will have to have separation dates, birth dates and all other time frames EXACT. it's very daunting to 'do-it-yourself' if you make a mistake it might mean loosing child or alimony support.
the pamplet costs about 20 dollars, to have papers filed is about 60 and then you have to pay the sheriff's department or whatever to deliver them to your husband which costs something like 35

divorces are expensive and very lengthy, i hope all goes well for you! good luck!

Go to Google.com and type in divorce, North Carolina....and go from there! Thats what I did only wiht California. Also if you think there will be no major fights over this divorce..go with a mediator instead of lawyers...much cheaper and easier!!!

Go to legal aid, it's free. Unfortunately, anything free isn't fast; so be prepared for about a two year wait. Sorry, but I really wanted to be honest with you!

Divorce is easiest when the couple agrees on thing so try not to fight over silly things.

the fastest easiest way is 2 file 2gether.
if that is not possible, then get sum1 to help u.
it sucks when there is a kid involved.

if you have children you have to be separated for a while, it varies by state. then go to legal aid, it is based on your income on what you pay. on my first marriage i went through legal aid and didnt have to pay anything
