Well, if you mean she's living in a separate house, but did live there for a certain amount of time in a fiscal year, then he can claim those months on his income tax, but if you mean they live in the same house but her MOTHER owns the house not him, he can still claim her as a dependent if he is supporting the household or even partial support of the household.

He can provided she lived there for at least 6 months of the year and he provided over half of her support. You have to factor in everything to (rent, power, water, medical, etc.....) So in effect he probably can legally claim his stepdaughter.

this for taxes? it says to claim someone as a dependant, you have to supply 50% of the finances to support that person. but they have to live in same house. im sure.
does he pay the housepayment, her clothing, her food, her utilities? if yes, then yes he can, but check with a tax person for sure, they are different for different states.
