Now 1st & 4MOST.....this does not pertain 2me b4 any starts throwing stones, & this is a question 4those who have knowledge on the situation (in terms of the law n what not) so 4anyone who can offer insightful feedback please feel free 2 reply.... But the question is self explanatory. If some1's identity is used during a crime, how is that corrected, how is a warrant removed from the "innocent person" being portrayed thru the criminal. How is their identity protected, how is the legal side of it corrected, & how does the victim regain their innocence... all knowledge from both ends involving this situation is desired (both ends being the criminal as far as what steps 2 take in correcting it, & the victim, as far as redeeming their innocence)

In most cases, an attorney is needed. If/When the criminal is caught and proven that it is indeed that person using another persons identity, then the police should issue a statement or report stating that the actual named person has been a victim of identity theft. It is recommended that you carry that paper with you at all times in case you are ever stopped by police, questioned, anything, to prove your innocence. Police SHOULD check for all outstanding warrants, etc. but they are not required to do so, therefore you are always susceptible as a victim of identity theft. You need someone who can constantly monitor your reports, not just credit, but mail, medical, criminal, everything for the duration of your life. I just represented a client who committed felony tax fraud. She used her dad's ID to file a fraudulent tax return to avoid child support.

Initially, the dad was arrested by federal agents for tax fraud. The perpetrator confessed that her dad was an innocent.

The cops released the dad without bail, but there was still a case pending against the dad in court.

When I attended plea negotiations for my client (the criminal daughter), the prosecutor knew and understood what happened, and she dismissed the case against the dad immediately.

The criminal dismissal against the innocent was the easy part, I would be more concerned with the credit report of the innocent and the damage that could have been done to that.

I have learned that Experian, TRW, etc., have protocol to deal with setting the record straight, all you have to do is write them a letter and they'll tell you what they need. Hope this helps!!

This is not a simple question. And there isn't a list of steps to take that would universally apply. Even if everyone recognizes that someone else committed the crime, the victim whose identify is being used will a lot of times still get arrested and have to hire a lawyer. Then the victim will discover that no one is going to help him fix his records. He'll need lawyers for that. And whose going to pay for that? Very few jurisdictions would pay for it. You'll have a front page arrest story but no followup story saying how hard this is to redeem the innocent.
