I agree with the other posters. Your question is quite vague, ambiguous, overbroad and unclear. Why don't you try and talk about a specific case because it seems that you are trying to argue that our criminal justice system is actually "unjust."

In spite of overwhelming clear evidence against a guilty criminal, on what basis or in what circumstances could the criminal justice system release the guilty and incarcerate the innocent?

The facts are not clear in most cases. The US system assumes that the the defendant is innocent until proven guilty. If the government doesn't prove all the elements of a case, the person walks away free.
Yes, occassionally the guilty go free and even more rarely, the innocent are sent to jail. But that means someone made a mistake, either not paying attention to what they were doing, or not putting enough effort into what was going on.

its not justice its revenue and criminalizing the citizens to gain control. the criminals that should be in prison get out of prison to help the system recruit new felons for our great governments bussiness schemes such as halfway houses.the whole judicial system is corrupt. since when is testimony from a snitch credible? they say these criminals are credible to convict innocent as they run loose on the streets committing all the crimes they want because the cops are to stupid to actually investigate so they catch some snitch with dope and being the punks they are they dont want to own their own ****. the cops job is easy now and the dope addict gets to keep committing felony after felony without having to pay for there crimes. so whoever they can set up they do. the cops and the criminals are partners in convicting whoever they want to. even if they totally **** up the case the other half of the judicial system will lie and not do anything in good faith. our constitutional rights are being violated continuely, the DA's get their convictions and the judges get their investments secured. the halfway houses ,that set you up to fail. the saddest part, all these people that are suppose to protect the good people of this country are endangering our lives and our childrens lives. they have immunity from prosecution for the crimes they have commited against

That is a good question. You should read John Grisham's book "The Innocent man" It deals with guys on death row for almost 20 years before being retried with new evidence and set free.

You're the one making a sweeping and unsupported claim that our system knowingly sends innocent people to jail. I won't try to "justify" something like that when you haven't given us enough info to "justify" your assertion that innocent people are knowingly sent to jail.

First the system does not have to be justified, and everyone knows there are errors, but it is still the best system available
