Recently I asked about taking money out of a salaried employees pay to cover the cost of payroll over-ride from hourly employees. If Manager doesnt have a contract, never had one, and nothing in writing to say you will be responsible for hourly employees if payroll goes over employers budget, can he take the money from the managers pay to cover this over-ride? Do you think I will be "blackballed" if I took legal action agqainst this sort of Payroll-Robbery? Having money taken out of my check because hourly employees sometimes run into overtime, and get paid for their overtime, but I get hundreds of dollars taken out of my check to cover it. Hope this is enough info for someone to give me advice on what to do, because I cannot afford to just quit without a back-up plan.

What? That does not even sound legal!

I do not think they can do that. They could take it off your bonus but not your salary. If I were you I would seek some legal advice and I would also start job hunting. It is always easier to find a job if you already have one. If you are asked by a prospective employer why you are thinking of leaving don't tell them what is going on. Just say something about "professional advancement". I wish all the best of luck!

This is not even remotely legal. Report them immediately to your state's Department of Employment or Department of Labor. And get started looking for a job. Dept of Employment investigations take a while so you have time to look for another job but your employer is probably going to get hit with so many fines and penalties that they'll be out of business soon enough.

PS you should sue for a refund of all illegally deducted pay.
