He is a man who helped to thwart an assassination attempt on the life of the President of the United States brought an action against two newspapers for invasion of privacy. The first newspaper had published an article disclosing plaintiff's homosexual orientation. The second newspaper had reprinted information from the first article. The trial court granted defendants' motions for summary judgment. (Superior Court of the City and County of San Francisco, No. 695989, Ira A. Brown, Jr., Judge.)

The Court of Appeal affirmed. The court held that summary judgment was proper, since the record indicated the facts disclosed by the articles were not private facts, but were facts which plaintiff had left open to the eye of the public, and also because the publications were newsworthy, and thus protected by a privilege attaching to the truthful publication of newsworthy matters. (Opinion by Caldecott, P. J., with Poche and Panelli, JJ., concurring.)
